These terms are an agreement between you and Ganzhou Xiaomai Information Technology Co., Ltd. (“we”, “us”) covering your use of the Xpic iOS app. By installing or using Xpic you accept them. If you do not accept them, delete the app.
You give Xpic a photo. It detects the text in that photo, translates it, and returns a new image with the translation painted in place of the original text, keeping the layout as close to the original as it can. Translation is performed by an automated system, including a third-party AI provider — see the Privacy Policy.
This section matters more than the rest, so please read it.
Translations are produced by machines and will sometimes be wrong. Text may be missed, misread, mistranslated, or placed incorrectly. Prices, dosages, quantities, dates, warnings, allergen information, and legal or medical wording are exactly the kinds of content automated systems get wrong.
Do not rely on Xpic where being wrong matters. That includes medical, pharmaceutical, legal, financial, and safety decisions, and any situation involving allergies or hazardous materials. Verify anything important with a qualified human translator or the original source. Xpic is a convenience tool, not a professional translation service.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use one copy of Xpic on Apple devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, rent, lease, lend, sell, redistribute, sublicense, decompile, reverse engineer, or attempt to extract the source code of the app, except where that restriction is prohibited by law.
You keep all rights in the photos you upload. You grant us only the narrow, temporary permission needed to process that image and return a translation to you — nothing more, and only for as long as described in the Privacy Policy.
You are responsible for what you upload. By uploading an image you confirm that:
We do not review uploads in advance, and we do not build a library of them.
Do not:
We may suspend or terminate access that breaks these rules, or that we reasonably believe is abusive, without notice.
Xpic includes a one-time free allowance of 3 translations. It is a trial, not a daily quota: once used it does not reset. A Pro subscription raises the limit to 50 translations per calendar day (measured in UTC+8). If a translation fails on our side, it does not consume your allowance.
Pricing, renewal, and cancellation are covered in the Subscription Terms, which form part of this agreement.
We may change, suspend, or discontinue any part of Xpic, including limits and features. We rely on third-party providers and cannot promise uninterrupted service. Translated images are short-lived by design (see the Privacy Policy) — if you want to keep a result, save it to your own photo library.
If we change these terms materially, we will update the date above and give notice in the app where the change affects what you have paid for.
To the maximum extent permitted by law, Xpic is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that translations will be accurate or complete, or that the service will be error-free or uninterrupted.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of Xpic — including any decision you made based on a translation it produced. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, or for fraud.
Because Xpic is distributed through the App Store:
These terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-laws rules, except where the mandatory consumer law of your country of residence gives you stronger protection — in which case that law applies to the extent of the conflict.
